1. About IBC Recycle

IBC Recycle is a packaging company that buys, sells, recycles, and transports used industrial containers including IBC totes and tanks. We serve businesses across the United States and operate through our website ibcrecycle.com and direct sales channels.

2. Use of Our Website

You agree to use our website only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the website in any way that violates applicable federal, state, local, or international laws or regulations
  • Attempt to interfere with, compromise, or disrupt the website or its servers and networks
  • Use any automated system, including robots, spiders, or scrapers, to access the website for any purpose without our express written permission
  • Introduce any viruses, malware, or other harmful material to the website

3. Products and Services

Product Descriptions

We strive to provide accurate descriptions and photographs of our products. However, used and reconditioned containers may vary in appearance from photos shown on our website. Product grades (A, B, C) are defined in our grading standards and provide a reliable indication of condition. We recommend requesting samples for first-time orders.

Pricing

All prices displayed on our website are subject to change without notice. Quoted prices are valid for 30 days from the date of the quote unless otherwise specified. Prices do not include freight, taxes, or fees unless explicitly stated. We reserve the right to correct pricing errors.

Orders and Acceptance

Submitting a request or inquiry through our website does not constitute a binding order. All orders are subject to our acceptance, which we may decline at our sole discretion. An order is confirmed only when we provide written order confirmation via email or other written communication.

4. Payment Terms

Payment terms are established at the time of order confirmation. New customers are typically required to pay in advance or upon delivery (COD). Established customers may qualify for net-30 payment terms upon credit approval. Late payments may be subject to a service charge of 1.5% per month (18% per annum) or the maximum rate permitted by law, whichever is less.

5. Shipping and Delivery

Delivery dates are estimates and not guarantees. IBC Recycle is not liable for delays caused by carriers, weather, natural disasters, or other circumstances beyond our reasonable control. Risk of loss and title to products pass to the buyer upon delivery to the carrier (FOB origin) unless otherwise agreed in writing.

The buyer is responsible for inspecting all shipments upon delivery. Claims for damaged, defective, or incorrect products must be reported within 48 hours of receipt. Products returned without prior authorization will not be accepted.

6. Returns and Refunds

Due to the nature of used and reconditioned containers, all sales are generally final. However, if products do not match the agreed-upon grade or specifications, we will work with you to resolve the issue through replacement, credit, or refund at our discretion. Return shipping costs for valid quality claims are covered by IBC Recycle.

7. Container Purchasing (Selling to IBC Recycle)

When you sell containers to IBC Recycle, pricing is based on our assessment of container type, condition, quantity, and location. Quotes for purchasing your containers are valid for 7 days. Final pricing may be adjusted upon physical inspection if actual conditions differ materially from the description provided. Payment for purchased containers is made within 30 days of receipt at our facility.

8. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of IBC Recycle or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our express written permission.

9. Limitation of Liability

To the fullest extent permitted by law, IBC Recycle shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use our website or services
  • Any products purchased through our services
  • Any unauthorized access to or alteration of your data
  • Any statements or conduct of any third party on our website

Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid to IBC Recycle in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless IBC Recycle, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of our website or services, your violation of these Terms, or your violation of any rights of a third party.

11. Warranty Disclaimer

Used and reconditioned containers are sold “as is” according to their assigned grade. While we stand behind our grading standards and product descriptions, we make no warranties, express or implied, regarding the merchantability or fitness for a particular purpose of any used products. New products, where sold, carry the manufacturer's standard warranty.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of [applicable state], without regard to its conflict of law provisions. Any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in [applicable jurisdiction].

13. Dispute Resolution
